Where the Sahaba bloodthirsty? – إقامة الحدود

The Prophet used to make excuses for people who had committed sins that deserved prescribed punishments – in order to avoid punishing them.

His companions also used to cover and hide the sins of others – not seek them.

Ibn Abi Shaybah narrates with a good chain in (“Al-Musannaf”, 28008):

عن الثوري , عن علي بن الأقمر , عن يزيد بن أبي كبشة , عن أبي الدرداء
أنه أتي بامرأة سرقت يقال لها: سلامة , فقال لها: ” يا سلامة , أسرقت؟ قولي: لا ” , قالت: لا , فدرأ عنها
[مصنف عبد الرزاق الصنعاني (10 / 225) ح : 18922 ، مصنف ابن أبي شيبة (5 / 519) ح : 28574 . قال الألباني في إرواء الغليل (8 / 80) : ( إسناده جيد رجاله ثقات رجال الصحيح غير يزيد هذا , فذكره ابن حبان في ” الثقات ” , وروى عنه جماعة )]

The Companion Abu Darda said to a woman who had stolen: “O Salamah, did you steal? Reply: “No” to me.”

She said: “No.”

Then the punishment was averted from her.

Ibn Abi Shaybah has dedicated a chapter in his Musannaf called:

في الرجل يؤتى به فيقال أسرقت قل لا
“When they caught a man, they used to say to him: “Did you steal? Reply: No.”

He lists many other examples:

حدثنا أبو بكر قال حدثنا شريك عن جابر عن مولى لأبي مسعود عن أبي مسعود قال : أتي برجل سرق ، فقال : أسرقت ؟ قل : وجدته ، قال : وجدته ، فخلى سبيله

1- It was narrated that Abu Mas’ood said: they caught a man who stole something. He asked him: “Did you steal it?” Say: “I found it”, he said: “I found it.” Therefore he was released.

حدثنا أبو بكر قال حدثنا محمد بن بكر عن ابن جريج عن عكرمة بن خالد قال : أتي عمر بسارق قد اعترف ، فقال عمر : إني لأرى يد رجل ما هي بيد سارق ، قال الرجل : والله ما أنا بسارق ، فأرسله عمر ولم يقطعه .

2- On the authority of ‘ikrimah ibn Khalid, he said: they brought a thief who confessed to ‘Umar. Yet ‘Umar said: “I do not think that this hand belong to a theif, It is not a hand of a thief.” The man said: “By Allah I am not a thief.” ‘Umar released him and did not cut his hand.

حدثنا أبو بكر قال حدثنا عيسى بن يونس عن ابن عون قال : حدثني مسكين رجل من أهلي ، قال : شهدت عليا أتي برجل وامرأة وجدا في خربة ، فقال له علي : أقربتها ؟ فجعل أصحاب علي يقولون له : قل : لا ، فقال : لا ، فخلى سبيله .

3- A man and a woman who were strange to each other were found alone in a remote place. They were taken to Ali and Ali asked the man, “Did you get close to her?” Ali’s companions said to the man, “Say, No!” He said: “No.” Then they were left alone.

حدثنا أبو بكر قال حدثنا محمد بن بكر عن ابن جريج عن عطاء يقول : كان من مضى يؤتى بالسارق فيقول : أسرقت ؟ قل : لا ولا أعلم إلا سمى أبا بكر وعمر

4- On the authority of ‘Ataa, he said: “when they caught a thief [in the time of Abu Bakr and Omar], they used to say: “Did you steal? Reply: ‘No’ or say: “I do not know.”

حدثنا أبو بكر قال حدثنا محمد بن بشر قال حدثنا سعيد بن أبي عروبة عن سليمان الناجي عن أبي المتوكل أن أبا هريرة أتي بسارق وهو يومئذ أمير ، فقال : أسرقت ، أسرقت ، قل : لا قل : لا مرتين أو ثلاثا

5- It was narrated that when Abu Hurairah was the leader, they caught a thief. He asked him: “did you steal? Did you steal?” Say to me: “No.”, he repeated it two or three times.
